This document contains the Terms and Conditions that govern the use of this website and the contract that binds us—You and us. These Terms establish the rights and obligations of all users and Lunarte Canarias concerning the products and services offered through this website. Please read these Terms carefully before using this website or placing an order. By using this website or placing an order, you agree to be bound by these Terms. If you do not agree with all the Terms, you should not place any orders. These Terms may be modified, so you should read them before making each purchase. Lunarte Canarias is a Spanish company based in Playa de Arinaga. Rosa Delia Peraza Peña, with NIF-43659131W, owns the website www.lunartecanarias.es and makes it available to internet users for the aforementioned purposes.

I. Order Methods, Pricing, and Product Information

Users can place all their orders through the website www.lunartecanarias.es. Each Lunarte Canarias user declares they have full capacity to use credit cards and that these cards have sufficient funds to cover all costs resulting from the purchase of products through Lunarte Canarias. By clicking the "Pay" or "Buy" button during the purchase process, the user fully and unreservedly accepts these General Terms and Conditions of Sale. The data recorded by Lunarte Canarias serves as proof of the transactions made between Lunarte Canarias and its customers. Lunarte Canarias will confirm your order via email. The contractual information is presented in Spanish and will be confirmed no later than at the time of delivery. Shipping costs are not included in the prices and will be calculated at the end of the purchase based on the shipping address. At Lunarte Canarias, there is no minimum purchase amount. Lunarte Canarias reserves the right to change its prices at any time, but products and delivery services will be billed based on the rates in effect at the time the order is placed (subject to the availability of the product or delivery service). Lunarte Canarias reserves the right to cancel any order if any anomalies are detected in the prices, discounts, descriptions, or features of the published products. By making a purchase at Lunarte Canarias, the user or customer declares they have read and understood all the information regarding the purchased products. 

II. Availability

At Lunarte Canarias, all garments are custom-made. However, it may happen that a specific thread is unavailable. In such cases, Lunarte Canarias will contact the customer to offer a thread substitution or, if the change is not satisfactory, a refund of the amount paid.

III. Payment

Purchases can be made using bank cards (credit and debit, VISA, and MasterCard), PayPal, Bizum, and bank transfer. The availability of these payment methods is subject to the discretion of Lunarte Canarias at any time. By making a purchase on Lunarte Canarias, you accept the terms and conditions as well as the privacy policy of our service providers or payment gateways. Accepted bank cards include Visa and MasterCard. This merchant commits to not allowing any transaction that is illegal or considered by credit card brands or the acquiring bank to have the potential to harm their goodwill or negatively impact them. The following activities are prohibited under the card brand programs: the sale or offering of a product or service that does not fully comply with all applicable laws for the Buyer, Issuing Bank, Merchant, Cardholder, or cards. Furthermore, the following activities are explicitly prohibited: child pornography, violence/hate, and extreme sexual violence. IV. Delivery Times

Since these are handmade products, the order will begin processing after the 48-hour cancellation period at no cost. Each item has an estimated production time, though this may vary depending on the workload at the time of the order. Once the item is completed, we will contact the customer to inform them about the product shipment and the selected shipping agency.

V. Exchanges and Returns

At Lunarte, all clothing items are custom-made, which means exchanges or returns are not possible, as they are crafted based on the measurements provided by the customer.

However, products that are not custom-made (such as wallets, bags, etc.) can be returned within 5 days of receiving the product. Return shipping costs are the responsibility of the customer. The refund will be processed once the product is received at our workshop.

VI. Cancellations

Once the order is placed, the customer has up to 48 hours to cancel it at no cost. After this period, if the order is canceled, 50% of the amount paid will be refunded. To cancel the order, you must email us with your order number, and we will refund the full or partial amount depending on the time elapsed since the order was placed.

VII. Liability, Disputes, and Applicable Law

The client or buyer acknowledges being informed of the details and characteristics of the purchased products and agrees with the information provided by Lunarte Canarias. The client declares that: They are of legal age in accordance with current legislation. They are authorized to use the account, card, or payment method provided for the purchase. They acknowledge and consent to receiving the product at the location and under the conditions specified during the purchase process. The information provided during the process is accurate and truthful, and they are aware of the product details. To contact Lunarte Canarias, you may do so via email or the contact form. Lunarte Canarias shall not be held responsible for non-compliance with the agreement in cases of force majeure, disruption, or total or partial strikes, particularly affecting postal services, transportation, and/or communication services, floods, or fires. In case of dispute, the member shall prioritize seeking an amicable solution with Lunarte Canarias. These General Terms and Conditions are governed by Spanish law. The parties agree, at their choice, to submit any conflicts and waive any other jurisdiction, to the courts and tribunals of the user’s domicile.

VIII. Modification of General Terms and Conditions of Sale

Lunarte Canarias reserves the right to modify the general terms and conditions of sale without prior notice, including the ability to change, remove, or add content and services provided through the website, as well as the way they are presented or located on its servers. These changes must be accepted by the User each time they make a purchase through the Lunarte Canarias website. Members of Lunarte Canarias who disagree with the modifications to the general terms and conditions must notify the company and, from the date the new version takes effect, cease using Lunarte Canarias' services. If any of the terms in the general conditions are deemed illegal or unenforceable, they shall be considered null and void, with the agreement between the parties prevailing, or in its absence, the provisions of the Spanish Civil Code will apply.

IX. Electronic Notifications

Lunarte Canarias may contact users at any time through all available channels, based on the information provided by the user, such as email, phone, SMS, or WhatsApp, among others.
